Merging is disaffiliation

So how does UM Panhel and UM IFC allow sororities to pregame with merger fraternities but not with disaffiliated fraternities? Usually at least half if not more of a merger fraternity membership is made up of a fraternity membership that failed to follow IFC rules and disaffiliating from UM. Isn't it very hypercritical for IFC and Panhel to penalize disaffiliated fraternities that were in good standing with IFC but left to protect the Constitutional rights of students and fraternities, but IFC and Panhel say all is cool with merger fraternities that that got shut down for violations and just pretend to be another fraternity not in trouble now?
