It's a totally different situation. The Thetas who are now in AEPhi were never initiated. The NPC has rules against initiated members joining another sorority so none of the active Thetas can go anywhere else ever. So there already is a national rule about it. The uninitiated Thetas had nothing to do with the reasons for the closure, so they were fine to join somewhere else from every perspective. Fraternities are much looser about being able to get into another fraternity even when you've been initiated. So I think that's why the school stepped in since technically they were allowed to do it but those guys were in trouble with the university for the reasons they got closed in the first place.
