Yes they are not recognized by the university, but that does not mean they have no oversight. They are still chartered and are held accountable by their nationals. They just don't have to deal with the ridiculous standards the school tries to impose on the on-campus fraternities. At literally any other school, videos with alcohol are completely normal and not used to start witch hunts against the houses.
