Whoever posted the video on YouTube created the hostile learning Enviroment. See below

As Geoffrey R. Stone, a professor of law at the University of Chicago, noted in the New York Times, "The statements were made in the innocuous setting of a bus, and any disruption came from the showing of the video, not from the students' speech."
