is this for real??? illegal in 2019!

Ok so I’m a Senior in the Greek system and my little brother is an incoming freshman. He got a letter about joining the new frat TKE. They said in the letter that they have a height requirement of 5’10 or higher? Is this even legal?
I know they were the top house at SDSU in the nineties but man. This is borderline discrimination isn’t it?
