Why would you ask such an insensitive question?

"insensitive" to who? I'm pretty sure the surviving family members already know that their loved ones died.

It's insensitive because it implies that the Sig Ep intended to kill someone, when actuality, it was just a tragic accident.

“The allegation is that he did unlawfully, willfully, and feloniously, with malice aforethought kill and murder Felicia Harris.”

Assistant District Attorney Jeff Nieman repeated those words, “the allegation is that he did unlawfully, willfully, and feloniously, with malice aforethought kill and murder” the other two victims who died in the crash – 46-year-old Darlene McGee and six-year-old Jahnice Baird.

Use the search function. Or Google. The SigEp brothers were fighting over a girl.

Pretty sure this is someone trying to bait us or start something. Don't respond. He'll get bored and move on.

^ Pretty sure this is someone trying to bury the story of Sig Ep culpability.

You really have nothing better to do? Sad.

So if the SigEp brother he assaulted doesn't press charges or cooperate as a witness, then there is no "malice" and therefore no 2nd degree murder charges for the three persons killed?

No. Googling the law does not a lawyer make.

But that's the key case for the prosecution as murder, right?

Pretty sure the prosecutors noted the prior violence that night against frat brother before the (alleged) second degrees murders of three persons.

Because he was human. Humans make mistakes. If anyone says they are infallible, they are a liar. He drank that night, and drank A LOT. He wasn't 21, so it was illegal. He had a fake ID, which was also illegal. He went to two bars and presented that fake ID - which made them culpable when they served him alcohol. He drank, and drank, and drank. Then he got upset about a girl. Things that bother us tend to be blown out of proportion when we drink. Then he got in his car and drove the wrong way on an Interstate and killed three innocent people. I'm not sure if that answers your "question", but that is what happened. Several lives were ruined that night.
