Yes. It is more difficult to get into a 'top 5' house if you're not a freshman. Can be done, and is done, but the numbers work against you.

FSU has as separate upperclassmen quota. Sophomores and juniors are lumped in with freshmen. All chapters take sophomores and juniors.
